MID DEVON DISTRICT COUNCIL HEREBY REFUSES FULL PLANNING PERMISSION FOR THE ABOVE DEVELOPMENT

Reason for Refusal: 1. In the opinion of the Local Planning Authority the proposal is contrary to paragraphs 180 e) and 189 a) of the National Planning Policy Framework, Policies DM1 and DM4 of the Mid Devon Local Plan 2013-2033 and Policy M25 of the Devon County Council Minerals Plan 2011-2033. A significant amount of earthworks are proposed to be re-located and deposited on an area of land on a steep slope. A robust site investigation/geological report, written by a person with a recognised relevant qualification, sufficient experience and membership of a relevant professional organisation, has not been submitted in support of this application. So, it is therefore not possible to determine if the proposal would result in a harmful and unsafe impact upon in terms of contamination and instability. The potential for harm is not considered to be outweighed by other benefits of the proposal. Statement of Positive Working In accordance with paragraph 38 of the National Planning Policy Framework the Council has worked in a positive and pro-active way with the Applicant and has looked for solutions to enable the grant of planning permission. However the proposal remains contrary to the planning policies set out in the reasons for refusal and was not therefore considered to be sustainable development.
